A Digital Twin is an AI Agent modelled on a real individual using their likeness, voice, appearance, biographical information, and areas of expertise. The following rules apply to all Digital Twins created through Napster products.
Creating a Digital Twin of yourself
You may create a Digital Twin of yourself (a Personal Digital Twin) after completing Napster's identity verification process. By doing so, you confirm that all inputs you provide are exclusively your own and that you have full authority to authorize the creation and deployment of your Digital Twin.
Creating a Digital Twin of someone else (private individual)
You may only create a Digital Twin of another private individual if you have obtained their prior, express, written consent (Digital Twin Consent) before initiating creation. The consent must:
- Identify the individual by full legal name
- Describe the specific intended use case, deployment context, and audience
- Specify the duration of the authorization (or confirm it is indefinite)
- Include the individual's explicit acknowledgment that their likeness, voice, and biographical information will be used to create an AI-generated synthetic representation
- Be signed or authenticated by the consenting individual
You must keep records of this consent for a minimum of 3 years and provide them to Napster within 5 business days of any request. You must stop using the Digital Twin immediately if consent is revoked.
Public figures and celebrities
You may not create a Digital Twin of any public figure, celebrity, athlete, politician, recording artist, or other individual whose name, image, likeness, or voice has commercial value — without prior written authorization from Napster following completion of Napster's enhanced verification process. Attempts to bypass these controls constitute a material breach of the Terms of Service and may result in immediate account termination.
Prohibited uses
You may not use Digital Twin functionality to:
- Impersonate, defame, harass, stalk, or threaten any individual
- Generate non-consensual intimate imagery or audio
- Create content designed to deceive, defraud, or manipulate anyone
- Circumvent any identity verification or content moderation system
- Violate any law governing synthetic media, digital replicas, or rights of publicity
Synthetic media disclosure
When you publish or distribute any Digital Twin content that depicts a real individual, you must include a clear and conspicuous disclosure identifying the content as AI-generated or synthetic, consistent with applicable law in the jurisdiction(s) where the content is published.
Requesting removal of a Digital Twin
If you believe a Digital Twin has been created using your likeness, voice, or biographical information without your consent, submit a takedown request to:
